Rental Conditions

§1 Rental objekt and key

The landlord rents to the tenant the following accommodation ("rental property"): Country house "Casa Emilia" for maximum 4 persons with pool 1. the rental property is fully equipped and furnished. Bed linen and towels are included in the rental price. 2. the tenant is entitled to use the entire house (with the exception of the locked cupboards), the garden and the pool during the rental period. The following facilities are also available for free use: Car parking space, washing machine, TV with SAT reception, mini stereo with DVD player. 3. the tenant receives 1 front door key, 1 key for the entrance gate for the duration of the rental period. 4. the rental object is rented to the tenant for an agreed period of time and may not be used for permanent residential purposes.

§2 Legally binding booking

A legally binding tenancy agreement for a certain period of time comes into effect when the booking is 1. with a completed and signed booking form is received by the landlord by e-mail or post. or 2. By initiating the booking via our website and entering the required data and the payment modalities. Upon confirmation of your entries, you will subsequently receive a booking confirmation by e-mail. In this case, the rental contract is binding without the signature of the landlord and/or tenant.

§3 Arrival and departure, stay

1. occupation of the rented property is possible from 3:30 p.m. on the day of arrival. 2. the rented property must be handed over by 10 a.m. at the latest on the day of departure. 3. the landlord will provide the tenant with the name of a guest service on site with whom the handover of the keys can be arranged by telephone. The guest service will also explain everything important about the rented property on site and, if necessary, will also be available to answer questions during the stay. 4. at the end of the rental period, the tenant must hand over the rented property in proper condition with the keys provided to the landlord's guest services. 5. the rented property is to be handed over in a swept clean condition. The used dishes should be washed, the dishwasher emptied, the oven and grill cleaned. 6. the rubbish has to be disposed of by the tenant until departure.

§4 Rental price, deposit and method of payment

1. the rent includes the additional costs like electricity, water, wifi, towels and bed linen. 2. the cost of the final cleaning is 100€. 3. firewood is not included in the rental price. 4. the tenant can optionally book gas bottles for the central heating. 5. the rent is to be paid as follows: 6. a deposit of 30% is due immediately after conclusion of the contract. 7. the remaining amount is to be paid at the latest 4 weeks before the beginning of the rental period. 8. if there are less than 28 days between the day of the conclusion of the contract and the day of the beginning of the rental period, the entire rental price is due immediately. 9. the lessor accepts payments by credit card / PayPal / bank transfer. 10. All payments, unless otherwise stated, will be processed through the website with the URL/address www.casa-emilia.com. 11. PayPal payment requests will be made from the following account: info@casa-emilia.com 12. if the tenant is more than 7 days in arrears with the payment, the landlord is entitled to terminate the contract without further notice and to rent the rented property to another tenant. 13. the deposit of 200,00€ is to be deposited in cash at the guest service of the landlord on arrival and will be refunded after a complaint-free handover on departure.

§5 Cancellation and interruption of stay

1. If the tenant cancels (terminates) the contract before the start of the rental period without naming a new tenant who will enter into the contract under the same conditions, the following pro rata rents (excluding final cleaning) shall be paid as compensation, taking into account the expenses saved, insofar as it is not possible to rent the property to another tenant: Cancellation up to 70 days before the start of the rental period: 30% of the rental price up to 56 days before the start of the rental period: 50% of the rental price up to 42 days before the start of the rental period: 80% of the rental price up to 28 days before the start of the rental period: 90% of the rental price otherwise (later than 14 days before the start of the rental period) 100% of the rental price. The landlord shall nevertheless endeavour to let the rented property to other tenants. The tenant can prove a lesser damage at any time. 2. if the tenant terminates the stay prematurely, he remains obliged to pay the full rental price. 3. Cancellation or termination can only be made in writing. The date of receipt of the declaration by the lessor is decisive.

§6 Liability and obligations of the tenant

1. the rented property, including the furniture and other objects in it, shall be treated with care. The Hirer shall urge the persons accompanying and/or visiting him/her to exercise care. The Hirer shall be liable for culpable damage to the rented property, the furniture or other items in the rented property by him or persons accompanying him. 2. defects which arise on taking over the rented property and/or during the rental period are to be reported immediately to the guest service in a suitable form. 3. the keeping of animals in the rented property is not permitted. 4. the landlord expressly points out that the rented property is a property in the rural part of a mountain village and that the landlord accepts no liability for injuries, accidents or other damage incurred by the tenant or persons accompanying him in this context. Similarly, liability for cash or property of the tenant on the part of the landlord is excluded. Liability for damage to health which may be caused by the use of the swimming pool or other objects in the rented property is also excluded. The Hirer shall exercise particular caution, especially with regard to children accompanying him/her. 5. the rental property may only be occupied by a maximum of 4 persons. Violation of this clause may result in the immediate termination of the rental agreement. In this case, the landlord is entitled to expel the tenant and all persons accompanying him from the house and to retain all payments made. 6. the tenant undertakes to observe the leaflets and house rules available on arrival. The place of jurisdiction is the country of residence of the landlord/owner.
